There are several circumstances where having an effectively drafted Prenuptial or Postnuptial Agreement would benefit your situation.
Prenuptial Agreement
A Prenuptial Agreement is a contract entered into by parties before they marry. It can spell out how property will be distributed if the parties divorce or one party passes away, what will be considered separate property during the marriage, and the terms for spousal support. A Prenuptial Agreement cannot decide the terms of child custody or child support. A Prenuptial Agreement can be beneficial for those entering into second marriages, people who have children from previous relationships, or parties with significant assets they want to protect in case of divorce or death. At Shearin Law, our attorneys can de-mystify Prenuptial Agreements and review and advise you as to whether a Prenuptial Agreement is right for you. We can alleviate any fears you may have in preparing one or signing one.
Postnuptial Agreement
A Postnuptial Agreement is a contract made between two people after marriage to protect their interests in case of divorce. There are many reasons why a couple might want to enter such a contract after marriage. For instance, a Postnuptial Agreement can be an effective tool when parties reconcile after a separation that does not end in divorce. It can also be used during a marriage to designate an asset acquired during the marriage as one person’s separate property. A couple can also use a Postnuptial Agreement to formalize an agreement that certain property will be considered marital property in the event of divorce. Our attorneys can identify situations where a Postnuptial Agreement would be valuable and walk you through the process of drafting and signing such an agreement.
